Dr. Rodriguez.<\/a><\/p>\n<p>San Luis, Septiembre veintiuno de dos mil quince.-<\/p>\n<p><strong><span style=\"text-decoration: underline;\">AUTOS Y VISTOS<\/span><\/strong>: Para resolver la excusaci\u00f3n formulada en los autos caratulados: \u201c<strong>DR. ESTRADA LEANDRO ALFONSO C. JUEZ DEL JUZGADO DE INSTRUCCI\u00d3N EN LO PENAL N\u00b0 2- 2 C.J. DTE. DR. ESTRADA DUBOR FEDERICO\u201d <\/strong>Expte. N\u00b0 1-E-2014;<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Y CONSIDERANDO<\/span><\/strong>: I) Que a fs. 204, el Sr. Procurador General Subrogante de la Provincia de San Luis, Dr. Fernando Alberto Rodr\u00edguez se excusa de entender en la presente causa, en los t\u00e9rminos de los Arts. 33 y 17 inc. 1 del C.P.C. y C., en virtud que en la actual composici\u00f3n del Honorable Cuerpo, el Dr. Ernesto \u00c1lvaro Rodr\u00edguez, la integra como miembro titular en represtaci\u00f3n de los abogados de la matr\u00edcula y con el cual guarda un parentesco de segundo grado de consanguinidad.-<\/p>\n<ol>\n<li>II) Que atento lo solicitado, cabe advertir que las causales de recusaci\u00f3n o excusaci\u00f3n previstas en la Ley N\u00ba VI-0478-2005 \u2013 TEXTO ORDENADO Ley XVIII-0712-2010 &#8211; Ley VI-0640-2008, en su art. 12, solo refieren en relaci\u00f3n al <em>enjuiciado<\/em> o As\u00ed expresa: <em>\u201cLos miembros del Jurado de Enjuiciamiento, podr\u00e1n ser recusados con causa y deber\u00e1n excusarse por las siguientes causas <strong>con relaci\u00f3n tanto al enjuiciado como el denunciante<\/strong>: a) Parentesco hasta el cuarto grado de consanguinidad y segundo de afinidad<\/em>\u2026\u201d.-<\/li>\n<\/ol>\n<p>En ese sentido, y por corresponder, el apartamiento solicitado debe ser denegado.-<\/p>\n<p>Por ello <strong><span style=\"text-decoration: underline;\">SE RESUELVE<\/span>:<\/strong> 1) RECHAZAR el pedido de excusaci\u00f3n formulado por el DR.
