Estrada.<\/a><\/p>\n<p>SAN LUIS, Febrero trece de dos mil diecisiete.-<\/p>\n<p><strong><span style=\"text-decoration: underline;\">AUTOS y VISTOS<\/span><\/strong>: Para resolver la excusaci\u00f3n formulada por el Procurador General, Dr. Fernando Oscar Estrada, en autos: <strong>Dres. FLORES, Domingo, AIZPEOLEA, Silvia In\u00e9s y FLORES, Jos\u00e9 Luis \u2013 Jueces de la Excma. C\u00e1mara Penal, Correccional y Contravencional N\u00b0 1, 1\u00b0 C.J., Dr. ESTRADA, Fernando Oscar \u2013 Procurador Gral. de la Pcia. y Dra. BERNAL, Diana \u2013 Fiscal de C\u00e1mara Penal N\u00b0 1, 1\u00b0 C. J. y Otros \u2013 Dte. Sr. BARROSO, Jorge Salvador <\/strong>&#8211; Expte. N\u00b0 2-F-2016; y,<\/p>\n<p><strong><span style=\"text-decoration: underline;\">CONSIDERANDO<\/span><\/strong>: Que, tal como luce a fs. 164, el Procurador General de la Provincia, Dr. Fernando Oscar Estrada, solicit\u00f3 se lo excuse de intervenir en la causa de referencia, en raz\u00f3n de ser uno de los denunciados en la misma; por lo que consider\u00f3 encontrarse comprendido en el art. 12 inc. e) de la Ley N\u00b0 VI-0478-2005 \u2013 Texto Ordenado Ley XVIII-0712-2010 \u2013 Ley VI-0640-2008.<\/p>\n<p>Que, efectivamente, tal como puede apreciarse en la denuncia de fs. 12\/23vta., el Dr. Estrada es uno de los denunciados en la causa, por lo que se encuentra comprendido en el inciso e) del art\u00edculo 12 de la Ley N\u00b0 VI-0478-2005 \u2013 Texto Ordenado Ley XVIII-0712-2010 \u2013 Ley VI-0640-2008, que impone la excusaci\u00f3n en caso de tener inter\u00e9s en la causa que motiva el enjuiciamiento.<\/p>\n<p>Por lo expuesto, <strong><span style=\"text-decoration: underline;\">SE RESUELVE<\/span><\/strong>: I) Hacer lugar a la excusaci\u00f3n formulada por el Dr. Fernando Oscar Estrada a fs. 164.-<\/p>\n<ol>\n<li>II) Dese intervenci\u00f3n al subrogante legal.-<\/li>\n<\/ol>\n<p>REG\u00cdSTRESE y NOTIF\u00cdQUESE.- FDO.
