DR. SABAINI ZAPATA JORGE EDUARDO- JUEZ DEL JUZG. DE INSTRUCCI\u00d3N EN LO PENAL Y CORRECCIONAL N\u00b0 2- 1\u00b0 C.J.- DTE.: SRA. MERCAU MARTA CELIA\u201d<\/strong> Expte. N\u00b0 2-S-17,<\/p>\n<p><strong><u>Y CONSIDERANDO<\/u><\/strong>: I) Que a fs. 2 la Sra. Marta Celia Mercau D.N.I. N\u00ba 17.189.915, presenta ante este Honorable Jurado de Enjuiciamiento denuncia de prevaricato (art. 269 del C\u00f3d. Penal) contra el Dr. Jorge Sabaini Zapata, Juez titular del Juzgado de Instrucci\u00f3n en lo Penal N\u00ba 2 de la 1\u00ba Circunscripci\u00f3n Judicial, quien actu\u00f3 como juez de la causa PEX N\u00ba 125728\/12 \u201cGINETTE MARILYN CEJAS AV. MUERTE\u201d durante el periodo 2012\/2014, y orden\u00f3 el archivo de la causa argumentando que no exist\u00edan elementos para la investigaci\u00f3n, agregando la denunciante que la misma fue mala, desidiosa e ineficiente.<\/p>\n<ol>\n<li>II) La cuesti\u00f3n tra\u00edda a estudio ha devenido abstracta, al haber finalizado la intervenci\u00f3n del Dr. Jorge Sabaini Zapata como Juez del Juzgado de Instrucci\u00f3n en lo Penal N\u00ba 2 de la Primera Circunscripci\u00f3n Judicial, desempe\u00f1\u00e1ndose en la actualidad como Juez de la C\u00e1mara de Apelaci\u00f3n Penal N\u00ba 2 de la 1\u00ba Circunscripci\u00f3n Judicial. Por lo que ha cesado la existencia de la situaci\u00f3n f\u00e1ctica motivante del resultado pretendido por el denunciante, correspondiendo que as\u00ed se declare como lo ha hecho este Honorable Jurado en otros precedentes, entre ellos: <strong>\u201cDDO. DRA. PIGUILLEM DE LOMBARDI SANDRA- JUEZ DE CAMARA DE LA 3\u00b0 C.J.- DTE.: DR. SALOMON CARLOS ALBERTO \u201d<\/strong> N\u00b0 1-P-03 en fecha 24\/05\/2004; <strong>\u201cDDO. DR. VON LAPCEVIC SASCHA- JUEZ DEL JUZGADO CIVIL, COMERCIAL Y MINAS N\u00b0 3- 2\u00b0 C.J.- DTE.: DR. TORRES ANIBAL CESAR\u201d<\/strong> Expte. N\u00b0 1-V-00 en fecha 09\/05\/2005<\/li>\n<\/ol>\n<p>Por lo que <strong><u>SE RESUELVE<\/u><\/strong>: 1) Declara abstracta la denuncia formulada contra el Dr. JORGE EDUARDO SABAINI ZAPATA.-<\/p>\n<p>2) Ordenar el archivo de la causa.-<\/p>\n<p>REGISTRESE Y NOTIFIQUESE.
