Linardi.<\/a><\/p>\n<p>San Luis, abril veintitr\u00e9s de dos mil dieciocho.-<\/p>\n<p><strong><u>AUTOS Y VISTOS:<\/u><\/strong> Para resolver la excusaci\u00f3n formulada en los autos caratulados: \u201c<strong>DENUNCIADA: DDA. DRA. ALCARAZ DIAZ CINTHYA NATALIA &#8211; JUEZ TITULAR DEL JUZGADO CIVIL, COMERCIAL Y MINAS N\u00ba 3 DE LA 2\u00ba C.J. &#8211; DTE. DR. CUESTA VICENTE DANIEL\u201d, EXPTE. N\u00ba 01-A-2018, JUR N\u00ba 14\/18;<\/strong><\/p>\n<p><strong><u>Y CONSIDERANDO:<\/u><\/strong> I.- Que en fecha 16\/04\/18 se presenta la Dra. Mariel Elisabet Linardi, Miembro Suplente del Honorable Jurado y se excusa de intervenir en la presente causa, por encontrarse comprendida en la causal de del art.12 inc. e) de la Ley del Jurado, toda vez que ha intervenido como Juez de C\u00e1mara firmando distintas resoluciones judiciales, en los autos caratulados: \u201cBANCO NACION ARGENTINA C\/ CRISTOBAL ALBERTO MONTERO S\/ EJECUCION HIPOTECARIA\u201d Expte. N\u00b0 109161\/96, con tramitaci\u00f3n ante la C\u00e1mara Civil N\u00b01 de la 2da. Circunscripci\u00f3n Judicial de la que es Juez natural, que motiva la presente denuncia contra la Sra. Magistrada, raz\u00f3n por la cual se excusa de intervenir en las presentes actuaciones (art. 12 inc. e) de la Ley N\u00b0VI-0478.2005-T.O Ley XVIII-0712-2010-Ley VI-0640-2008 (Ley del Jurado de Enjuiciamiento) y arts. 30 y 32 del CPCC de aplicaci\u00f3n supletoria, solicitando su apartamiento.<\/p>\n<p>II.- Que atento al pedido de excusaci\u00f3n formulado por la Dra. Linardi, y vista la causa que es motivo de la presente denuncia -EXPTE. N\u00ba 109161\/96-, consideramos que la causal invocada -art. 12 inc. e) de la Ley N\u00b0VI-0478.2005-T.O Ley XVIII-0712-2010-Ley VI-0640-2008)- se encuentra debidamente objetivada, por lo cual resulta procedente hacer lugar al apartamiento requerido, por ser la Dra. Mariel Elisabet Linardi, Juez natural de la causa ante la Excma. C\u00e1mara Civil N\u00b0 1 de la 2da. Circunscripci\u00f3n Judicial.<\/p>\n<p>Por ello,\u00a0<strong><u>SE RESUELVE<\/u><\/strong>: Hacer lugar a la excusaci\u00f3n formulada por la Dra. Mariel Elisabet Linardi.<\/p>\n<p><strong>REGISTRESE Y NOTIFIQUESE.-<\/strong><\/p>\n<p><em>\u201cLa presente actuaci\u00f3n se encuentra firmada digitalmente en el sistema de gesti\u00f3n inform\u00e1tico Iurix por la Sres.
