Dr. Ur\u00eda.<\/a><\/p>\n<p>SAN LUIS, Febrero diecisiete de dos mil catorce.-<\/p>\n<p><b><span style=\"text-decoration: underline;\">AUTOS Y VISTOS<\/span><\/b>: Para resolver en los autos caratulados <b>\u201c<\/b><b>INCIDENTE DE RECUSACION EN AUTOS: LELOUTRE, CARLOS ALBERTO \u2013 3\u00ba C. J.- DTE. DR. SCARSO SALVADOR HUGO\u201d <\/b>Expte N\u00ba 3-I-13;<\/p>\n<p><b><span style=\"text-decoration: underline;\">Y CONSIDERANDO:<\/span><\/b> I.- Que en la presentaci\u00f3n de fs. sub 1\/ sub.15 el Dr. Salvador Hugo Sacarso con el patrocinio letrado del Dr. Esteban Jos\u00e9 Sala y en oportunidad de interponer formal denuncia contra el Dr. Carlos Alberto Leloutre, recusa con expresi\u00f3n de causa, de acuerdo a los establecido por el Art. 12 inc. e) de la Ley VI- 0478-2005, al Dr. Omar Esteban Ur\u00eda, en virtud de haber sido representante del Particular Damnificado en la causa de referencia.<\/p>\n<p>II.- Que a fs. sub. 20, el Sr. Ministro Dr. Omar Esteban Ur\u00eda, presenta el informe del art. 13 de la Ley VI-0478-2005, solicitando en el mismo, que oportunamente se haga lugar a la recusaci\u00f3n con causa planteada por el Dr. Salvador Scarso, ya que manifiesta haber intervenido como abogado defensor de la familia de la victima.<\/p>\n<p>III.- Que entrando al an\u00e1lisis de la cuesti\u00f3n tra\u00edda a resolver, se observa que el Dr. Omar Esteban Uria al efectuar el informe de Ley ha reconocido los hechos que se invocan como fundamento de la recusaci\u00f3n deducida en su contra, por lo que, en merito a dar cumplimento a las garant\u00edas del debido proceso corresponde admitir la recusaci\u00f3n con causa deducida, teni\u00e9ndolo por separado de la causa.-<\/p>\n<p>Por ello, <b><span style=\"text-decoration: underline;\">SE RESUELVE<\/span><\/b>: 1) Hacer lugar a la recusaci\u00f3n deducida en contra del Sr. Presidente del Jurado de Enjuiciamiento de la Provincia de San Luis, Dr. Omar Esteban Ur\u00eda.-<\/p>\n<p>REG\u00cdSTRESE.
