VOTO DE LOS DRES. OMAR ESTEBAN URIA, GONZALO JAVIER ESTRADA, JORGE OSVALDO PINTO, WALTER ALBERTO CEBALLOS Y DIP. RAMON ALFREDO DOMINGUEZ<\/span><\/b>: <\/b>Que la denuncia presentada no re\u00fane la totalidad de los requisitos formales exigidos expresamente en el art. 25 de la Ley N\u00b0 VI-0478-2005 \u2013 TEXTO ORDENADO Ley XVIII-0712-2010 – Ley VI-0640-2008, en tanto no ha acompa\u00f1ado fotocopia del D.N.I., L.E., o L.C., ni prueba supletoria que acredite identidad y domicilio de la denunciante; corresponde sin m\u00e1s tramite, ante el incumplimiento se\u00f1alado el archivo de las actuaciones, conforme as\u00ed lo dispone la norma antes referida (art. 25 inc. a) in fine), lo que no implica el decaimiento del derecho de la denunciante.-<\/p>\n

Tal criterio ha sido sostenido reiteradamente por el Jurado de Enjuiciamiento en los autos: \u201cDDO. DR. RUBIO FLORENCIO DAMIAN- MINISTRO DEL SUPERIOR TRIBUNAL DE JUSTICIA- DTE. SR. RUTI VICTOR HUGO\u201d Expte. N\u00ba 1-R-08, \u201cDDO. DRES. ASTUDILLO ANIBAL ATILIO, MONTOYA DE ZUCCO CLEOTILDE Y GATICA GUILLERMO ALFREDO- DTE. DR. CUESTA VICENTE DANIEL\u201d Expte. N\u00ba 1-A-11, entre otros.-<\/p>\n

Por\u00a0 ello, SE RESUELVE<\/span><\/b>: Archivar las presentes actuaciones por incumplimiento del recaudo exigido por el art. 25 inc. a) in fine Ley N\u00b0 VI-0478-2005 \u2013 TEXTO ORDENADO Ley XVIII-0712-2010 – Ley VI-0640-2008.-<\/p>\n

VOTOS EN DISIDENCIA: <\/span><\/b><\/p>\n

FUNDAMENTO DE LOS DRES. HORACIO G. ZAVALA RODRIGUEZ (h) Y <\/span><\/b>CARLOS GABRIEL SAMPER<\/span><\/b>: <\/b>Sin perjuicio de lo que consigna la Ley N\u00b0 VI-0478-2005 \u2013 TEXTO ORDENADO Ley XVIII-0712-2010 – Ley VI-0640-2008, en cuanto al cumplimiento de los requisitos formales para la admisibilidad e inicio del proceso que contempla la ley, no puede obviarse el derecho constitucional del debido proceso que considero debe estar por encima de cualquier formalidad que pudiera imponer una ley de jerarqu\u00eda inferior a la Constituci\u00f3n.-<\/p>\n

FUNDAMENTO DEL DR. CARLOS GUILLERMO VILLEGAS<\/span><\/b>: <\/b>No obstante que el suscripto en un caso similar \u201cDRES. ZAVALA RODRIGUEZ, HORACIO GUILLERMO, NOVILLO, LILIA ANA, URIA, OMAR ESTEBAN Y RUBIO, FLORENCIO DAMIAN \u2013 MINISTROS DEL S.T.J. Y ESTRADA, FERNANDO OSCAR \u2013 PROC. GRAL. \u2013 DTES. DRES. ROBLEDO, CARLOS S.J. Y GUTIERREZ, RICARDO A.\u201d <\/b>EXPTE. N\u00ba 1-Z- 2013, voto por el rechazo y el archivo de las actuaciones por incumplimiento del requisito formal del art. 25 de la Ley de Jury, considero que en el caso se debe priorizar la garant\u00eda del debido proceso por encima de aquel rigor formal. Por lo que adhiero en todo al voto que antecede.-<\/p>\n

Por ello, SE RESUELVE<\/span>:<\/b> Int\u00edmese a la denunciante a presentar fotocopia del DNI que acredite identidad y domicilio real, bajo apercibimiento de archivar las presentes actuaciones (art. 25 \u00faltimo p\u00e1rrafo).-<\/p>\n
