AUTOS Y VISTOS<\/span><\/b>: Para resolver en los autos caratulados \u201cDDA. DRA. CASTRO IRMA INES- JUEZ DEL JUZGADO CIVIL, COMERCIAL Y MINAS N\u00ba 1- 1\u00ba C.J.- DTE.: DR. SAMPER JOSE\u201d <\/b>Expte. N\u00ba 1-C-13.-<\/p>\n

Y CONSIDERANDO<\/span><\/b>: I) Que a fs. 99, se presenta el Sr. Presidente Dr. Oscar Eduardo Gatica, y solicita se lo excuse de entender en la presente causa, en raz\u00f3n de tener con el denunciante Dr. Jos\u00e9 Samper, enemistad grave y manifiesta.-<\/p>\n

Invoca, que dicho estado de \u00e1nimo fue generado por haber sido denunciado ante este Honorable Jurado de Enjuiciamiento en los autos: \u201cDDO. DR. GATICA OSCAR EDUARDO- MINISTRO SUPERIOR TRIBUNAL \u2013DTE. DR. JOSE SAMPER\u201d. Expte. N\u00b0 1-G-08, como asimismo en las causas: \u201cSAMPER JOSE – APELACION\u201d. Expte. N\u00b0 22\/08, \u201cSAMPER JOSE S\/ DENUNCIA\u201d. Expte. N\u00b0 970\/05 y \u201cSAMPER JOSE S\/ RECURSO EXTRAORDINARIO\u201d. Expte. N\u00b0 130\/08.-<\/p>\n

II) Que entrando en an\u00e1lisis de la cuesti\u00f3n planteada, este Honorable Jurado de Enjuiciamiento, entiende que la excusaci\u00f3n interpuesta debe ser admitida, por haberse configurado la causal invocada, prevista en el art. 12 inc. c) de la Ley N\u00ba VI-0478-2005 \u2013 TEXTO ORDENADO Ley XVIII-0712-2010 – Ley VI-0640-2008.-<\/p>\n

Por lo expuesto SE RESUELVE<\/span><\/b>: Hacer Lugar a la Excusaci\u00f3n formulada por el Sr. Presidente Dr. OSCAR EDUARDO GATICA, en consecuencia queda el Honorable Jurado de Enjuiciamiento integrado con el Dr. OMAR ESTEBAN URIA como Presidente, Miembros Titulares: Dr. GUSTAVO A.
