DE INSTRUCCI\u00d3N EN LO PENAL,\u00a0 CORRECIONAL Y CONTRAVENCIONAL N\u00ba 1- 2\u00ba C.J.- DTES. DRES. DEL CORRO EDGAR S. Y ANDREOTTI CARLOS E.\u201d<\/b>, Expte. N\u00ba 2-C-12;<\/b> y<\/p>\n

Y CONSIDERANDO:<\/span><\/b> 1) Que a fs. 148 el Dr. HORACIO G. ZAVALA RODRIGUEZ (h), se excusa de entender en la presente, en raz\u00f3n del grado de parentesco que lo une con el Sr. Ministro Dr. HORACIO GUILLERMO ZAVALA RODRIGUEZ (padre), de conformidad con lo prescripto por el art. 17 inc. 1\u00ba del C.P.C.C. de la Provincia.-<\/p>\n

2) Que esta causal se funda, en virtud de que los autos caratulados \u201cSalinas Julio Cesar y Otros- Su denuncia\u201d PEX N\u00ba 64139\/9 (expediente que origina la denuncia del Dr. Alfredo O. Cuello en estos autos), motivaron tambi\u00e9n la denuncia en contra de su padre ante este Jury, en los autos caratulados \u201cDENUNCIADOS: DRES. ZAVALA RODRIGUEZ, HORACIO GUILLERMO, NOVILLO LILIA ANA, URIA OMAR ESTEBAN, Y RUBIO FLORENCIO DAMIAN –\u00a0 MINISTROS DEL S.T.J. DENUNCIANTES: DRAS. ROBLEDO CARLOS S. J. Y GUITERREZ, RICARDO A.\u201d <\/b>– Expte. N\u00b0 01-Z-12.-<\/p>\n

Que las causales de excusaci\u00f3n ante el Jurado de Enjuiciamiento est\u00e1n previstas en el art. 12 de la Ley VI-0640-2008, siendo las mismas taxativas y de interpretaci\u00f3n restrictiva, por lo cual la causal esgrimida no se configura en autos por lo que la misma debe rechazarse.-<\/p>\n

Por ello, SE RESUELVE:<\/span><\/b> Rechazar la excusaci\u00f3n formulada\u00a0 por el Sr. Miembro Titular del Honorable Jurado, Dr. HORACIO G. ZAVALA\u00a0 RODRIGUEZ (h).-<\/p>\n
