DRA. OSTE VIVIANA ELIZABETH \u2013 JUEZ DEL JUZGADO DE FAMILIA Y MENORES N\u00ba 2 \u2013 1\u00ba C.J. \u2013 DTE. DR. NIETO CLAUDIO FABI\u00c1N\u201d<\/b> Expte. N\u00b0 5-O-14.-<\/p>\n<p><b><span style=\"text-decoration: underline;\">Y CONSIDERANDO<\/span><\/b>: 1) Que se advierte que existe conexidad de causa (Art. 22 inc. II), objeto y sujeto entre las presentes actuaciones y las que tramitan bajo la car\u00e1tula: \u201c<b>DENUNCIADA: OSTE VIVIANA ELIZABETH \u2013 JUEZ DEL JUZGADO DE FAMILIA Y MENORES N\u00ba 2 \u2013 1\u00ba C.J. DTE. DR. NIETO CLAUDIO FABIAN<\/b>\u201d Expte. N\u00b0 4-O-2014, lo que conduce a sostener la conveniencia de ordenar\u00a0 la acumulaci\u00f3n de ambas causas.-<\/p>\n<p>No teniendo la Ley de Enjuiciamiento de Magistrados y Funcionarios del Poder Judicial N\u00b0 IV-0478-2005, una disposici\u00f3n expresa sobre la acumulaci\u00f3n de procesos, corresponde, se aplique lo dispuesto en el art. 42 de la ley referida, por reenv\u00edo el art. 520 del C.Proc. Penal, el que remite a su vez a los arts. 188 y sgtes. del C.P.Cvs., y ordenar la acumulaci\u00f3n de las causas respetando el principio de prevalencia y teniendo en cuenta el estado de las mismas.<\/p>\n<p>Todo ello a los fines de garantizar el debido proceso y el m\u00e1s eficaz ejercicio del derecho de defensa del Magistrado denunciado.-<\/p>\n<p>Por ello, <b><span style=\"text-decoration: underline;\">\u00a0SE RESUELVE<\/span><\/b>: Acumular la presente causa a la que tramita bajo la car\u00e1tula:<b> <\/b><b>\u201c<\/b>\u201c<b>DENUNCIADA: DRA.
