Procurador General.<\/a><\/p>\n<p>SAN LUIS, Marzo diecis\u00e9is de dos mil quince.-<\/p>\n<p><strong><span style=\"text-decoration: underline;\">AUTOS Y VISTOS<\/span><\/strong>: Para resolver la excusaci\u00f3n formulada en autos caratulados <strong>\u201cDDO. DR. SABAINI ZAPATA JORGE-JUEZ DEL JUZGADO DE INSTRUCCI\u00d3N EN LO PENAL N\u00ba 2 -1\u00baC. J. -DTE. SR. ESCUDERO ROBERTO\u201d<\/strong>\u2013 EXPTE. N\u00b0 1 &#8211; S\u2013 14;<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Y CONSIDERANDO:<\/span><\/strong> 1.- Que a fs. 32 el Procurador General de la Provincia Dr. Fernando Oscar Estrada se excusa de entender en la presenta causa atento que, habi\u00e9ndose desempe\u00f1ado como Fiscal de Estado Adjutor de la Provincia, tuvo una activa participaci\u00f3n en la causa penal \u201cEscudero, Roberto\u201d (PEX\u00a0 30360\/6), extremos que surgen del expediente en cuesti\u00f3n, que ofrece como prueba. Manifiesta que en la causa precitada es donde y seg\u00fan el denunciante, se configuran las casuales de remoci\u00f3n del Sr. Juez de Instrucci\u00f3n denunciado.<\/p>\n<p>2.- Que la participaci\u00f3n del Dr. Fernando Oscar Estrada como Fiscal de Estado Adjutor en la causa \u201c\u201cEscudero, Roberto\u201d (PEX\u00a0 30360\/6), no resulta causal suficiente para que proceda la excusaci\u00f3n ya que lo que se investiga no es la causa penal sino la actuaci\u00f3n del Juez como denunciado, por lo que corresponde rechazar la misma.<\/p>\n<p>Por ello, <strong><span style=\"text-decoration: underline;\">SE RESUELVE:<\/span><\/strong> 1) Rechazar la excusaci\u00f3n formulada por el Sr. Procurador General Dr. Fernando Oscar Estrada.-<\/p>\n<p>REGISTRESE Y NOTIFIQUESE.-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>DESCARGAR:\u00a0\u201cDdo.
